Joe Biden and his administration have been under attack by activists ever since the Texas abortion law was passed.
Now, his Department of Justice, which he vowed to keep non-political, is making yet another political move.
Reports are now breaking that the Department of Justice is preparing to file a suit against Texas to fight the law.
Get Ready for War
According to the Wall Street Journal, Attorney General Merrick Garland is exploring “all options to challenge Texas S.B. 8 in order to protect the constitutional rights of women… including access to an abortion.”
After the law went into effect, Joe Biden stated that it was an “unprecedented assault on a woman’s constitutional rights.”
Democrats have tried to present this as an overturning of Roe v. Wade, but it is not.
While it is the strictest abortion law on the books, there is still some wiggle room for abortions to be conducted.
The biggest problem with the way Democrats are framing this is that the law hangs out women who have been raped, victims of incest, etc., as not having a choice.
That, however, is not the case.
While you could easily make the case someone having unprotected sex may not know they are pregnant within six weeks, that should not be the case in these other instances.
For instance, if a woman were raped, we would expect she would be taking pregnancy tests immediately to learn whether she had been impregnated by her rapist, so the Democrat argument does not really hold water here.
They are also trying to frame abortion itself as health care, which it is not in the majority of cases.
To support fighting the law, we have also seen Joe Biden made some big swings.
For instance, he no longer supports the Hyde Amendment, a law he supported his entire Senate career.
Biden is now also distancing himself from the widely accepted scientific definition of when life begins, which is at conception.
Expect a drawn-out, ugly fight over this that will not end anytime soon.
