New York’s new governor has just had her legs taken out from underneath her.
Governor Hochul’s mask mandate has been put on hold.
The ruling came down on Monday from State Supreme Court Judge Thomas Rademaker.
Crushing Blow
There is clearly a difference in opinion between the liberal and conservative mindsets in the judiciary.
Liberal judges have been embracing the idea of a dictatorship.
Conservative judges are trying to go with the idea of state legislators passing mandates rather than a governor or single official putting them in play.
To that point, Judge Rademaker has announced that Hochul overstepped her bounds on the statewide mask mandate she wanted to put in place.
This will reverse the December order that Hochul put in place just as Omicron started to surge around the country.
The mandate required masks be worn indoors for all public settings unless a vaccine requirement had been installed.
Rademaker did not actually argue against the mandate, but instead was of the opinion that “enacting any laws to this end is entrusted solely to the State Legislature.”
Hochul has announced that she will be fighting the decision, so expect an emergency request to get filed with the Supreme Court.
