The first reaction out of Joe Biden’s mouth should have been horror at the idea there was a leak regarding an opinion of a Supreme Court Justice.
Instead, all he did was rail against the opinion.
Not only that, but Biden also threatened to counter the Supreme Court with an executive action if the expected decision is handed down.
Ridiculousness
Democrats are losing their minds over this leaked briefing.
First off, we don’t even know if it will be the opinion yet, just that it was literally the first draft of an Alito opinion.
It could have been a pre-emptive draft hoping for a majority opinion for all we know.
I should also say that looking at the draft, abortions would not be illegal.
Instead, it would allow the states to determine abortion rights rather than federal law dictating abortion rights.
Regardless of what the opinion stated, the administration should have been outraged over the release of the draft.
Biden, however, stated, “If the Court does overturn Roe, it will fall on our nation’s elected officials at all levels of government to protect a woman’s right to choose. And it will fall on voters to elect pro-choice officials this November.
“At the federal level, we will need more pro-choice Senators and a pro-choice majority in the House to adopt legislation that codifies Roe, which I will work to pass and sign into law.”
This is now the rallying point for Democrats, with Senator Sanders (I-VT) even suggesting that the filibuster get nuked so Democrats can federally protect abortions now.
I do know one thing… and that is that Alito utterly destroyed the initial decision to federally protect abortions, showing how loosely the Constitution was used to preserve this as a federal right rather than one that should have always remained with the states.
According to Justice Alito, Roe v. Wade used the 14th Amendment to link privacy rights to abortion rights, which “was egregiously wrong from the start.”
