Supreme Court Rejects Trump Executive Privilege Claim

Former President Donald Trump had one last hope to shield his January 6 communications from House Speaker Pelosi (D-CA) and her January 6 Select Committee.

After losing an appeals court decision, Trump’s attorneys petitioned the Supreme Court as his last hope.

The case was declined, so all documents will now have to be turned over.

Big Defeat

The Supreme released the decision without a signature to the opinion.

That will probably infuriate Trump more than the decision itself.

The ruling stated, “The questions whether and in what circumstances a former President may obtain a court order preventing disclosure of privileged records from his tenure in office, in the face of a determination by the incumbent President to waive the privilege, are unprecedented and raise serious and substantial concerns.

“Because the Court of Appeals concluded that President Trump’s claims would have failed even if he were the incumbent, his status as a former President necessarily made no difference to the court’s decision.”

One Justice we know that was not in favor of this decision is Kavanaugh.

In January, he wrote, “A former President must be able to successfully invoke the Presidential communications privilege for communications that occurred during his Presidency, even if the current President does not support the privilege claim.

“Concluding otherwise would eviscerate the executive privilege for Presidential communications.”

This will be considered a massive loss for Trump, but I am looking at this as a win moving forward.

Biden’s administration has kept considerable documents from the public, so the precedent is now set that privilege is gone once one leaves office.

The moment Biden leaves office, this means that we legally have precedent for Republican lawmakers to obtain his communications, all of them, and I would wager that will be atop the list of things Republicans want if they can take back the White House in 2024.

This could expose Biden big league on China, Russia, and the Afghanistan withdrawal, not to mention all of his shady dealings with his son Hunter Biden.

Biden’s shortsighted thinking not granting Trump’s executive privilege claim will come back to bite him… you can bet on that.
